These Terms of Service (“Terms”) constitute a legal agreement between you (“you” or “User”) and Say Wishes (“we”, “us”, or “Company”) governing your use of our video customization, production, and digital delivery services at www.wishesvideo.com. By placing an order, paying for services, or using our Services, you accept and agree to these Terms.

2.1 “Services” means the video customization, production, and digital delivery services we provide, together with related account and order functions.

2.2 “Order confirmation” means the email we send after we receive full payment and confirm required materials have been submitted.

2.3 “Materials” means images, text, audio, and other assets you upload to support production.

3. Formation of the agreement: A binding agreement is formed when we receive full payment and your required Materials are successfully submitted and accepted. If Materials fail to upload or payment is not processed, we will refund any payment received within 3–7 business days and no agreement will be formed.

4. Performance & Delivery:

• We will begin processing your order within one business day of order confirmation.
• Delivery is digital only — delivered as an HD MP4 file to the email address you provided. See our Delivery Policy for full details.

5. Pricing & Payment: All prices displayed include applicable U.S. sales taxes where required. If a payment fails due to our system error, we will refund the payment within 3–7 business days.

6. No automatic right of withdrawal: Our videos are custom digital products made to your specifications. Under applicable rules for custom digital content, users generally do not have an unconditional right to cancel after purchase. Please review previews and order details carefully before payment.

7.1 Dissatisfaction: If you are dissatisfied with delivered content, contact support@wishesvideo.com within 14 business days with your order number and supporting evidence.

7.2 Policy: Refunds and cancellations are governed by our Refund Policy. Expedited (rush) fees may be refunded if we fail to meet the agreed expedited deadline.

7.3 Rework: We may charge for rework when issues arise from incorrect or ambiguous Materials you provided.

8. Storage: We retain order records and backups for up to 12 months. You are responsible for downloading and backing up delivered files.

9. User Warranties: You warrant that you own or have the right to use all Materials you upload. You grant us a license solely to produce your video.

10. Content Restrictions: You must not submit illegal, obscene, hateful, or prohibited content. We may refuse content that violates these Terms.

13. Limitation of Liability: Except where prohibited by law, our aggregate liability for any claim will not exceed the fees paid for the affected order.

15. Governing Law: These Terms are governed by the laws of the United States.
